The Wave Membership Terms and Conditions

- 1. General
- a. These terms and conditions (“Membership Terms“) apply to your membership of the surfing lake and associated facilities at The Wave, Washingpool Farm Main Road, Easter Compton, Bristol, BS35 5RE (the “Venue“).
- b. Please read these Membership Terms carefully as they form the basis of your contract with Surf Bristol Limited, a company registered in England and Wales (company number 07684630) whose registered office address is One Glass Wharf, Bristol, BS2 0ZX (“The Wave“, “we“, “our“, “us“) relating to your membership of The Wave (your “Membership“).
- c. By purchasing your Membership via our website and becoming a member of The Wave, you agree to accept and be bound by these Membership Terms. Please note that we reserve the right to cancel your Membership if you do not meet the eligibility criteria.
- d. You must be at least 18 years old to accept these Membership Terms (whether on your own behalf or on behalf of someone under the age of 18). Anyone under the age of 18 can become a member of The Wave, but a parent, guardian or authorised adult will be required to accept these Membership Terms on their behalf.
- e. All usage of the Venue, and the services which we may provide to you from time to time, is subject to our Terms and Conditions of Booking and Entry to The Wave.
- f. We will not be liable for any failure to perform, or delay in performance of, any of our obligations under these Membership Terms that is caused by any event or circumstance that is outside our reasonable control.
- g. There may be occasions where we have to close all, or part of, the Venue. We will try to let you know of any such closures in advance of them taking place, unless the problem is urgent or an emergency. If we are required to close the Venue for any reason, we will try to ensure that such closures are outside of peak visiting hours and are kept to a minimum, in both duration and frequency. Although any surf session booked under your Membership that has been cancelled because of such closure will be credited back to your account (see Section 6.g below), you will not be entitled to any refund of your Membership Fee (as defined in Section 2.c below) in such circumstances.
- h. We may terminate your Membership at any time by notifying you if you are in breach of these Membership Terms, our Terms and Conditions of Booking and Entry to The Wave or any rules or guidance which we may implement from time to time in relation to the use of the Venue. If we so terminate your Membership, you will not be entitled to any refund of your Membership Fee (as defined in Section c below) and all Membership Benefits (as defined in Section 2.a below) will immediately cease.
- i. Membership Benefits cannot be used in conjunction with any other promotion or discount.
- j. Except for cancellations during the “Cooling-Off Period” (see Section 4 below), Memberships cannot be refunded or exchanged for cash.
- k. The General Terms and Conditions for Promotions and Discounts apply to Memberships.
- 2. Your Membership
- a. We offer a number of different membership levels, full details of which are available on our website (“Membership Levels“). Each Membership Level has its own benefits, and you will only be entitled to the benefits associated with the Membership Level you select at the time of your membership application (“Membership Benefits“). However, you may upgrade your Membership Level at any time, as set out in Section 3 below.
- b. Once you have selected the Membership Level you would like, have purchased your membership product and accepted these Membership Terms, we will issue you with confirmation that your Membership has been accepted. Your Membership will start on the date you receive such confirmation and will continue for a minimum period of 12 months (the “Minimum Term”) after which it will continue on a rolling monthly basis until terminated in accordance with Section 2(d). (“Membership Term“).
- c. The monthly cost of your Membership will be as specified on our website at the time you purchase your Membership (“Membership Fee“). You agree to pay (i) the Membership Fee each month, in accordance with Section 5 below, for the duration of the Minimum Term; and (ii) our prevailing monthly rate following the expiry of the Minimum Term, until termination of your Membership.
- d. We will contact you via email during the final months of your Minimum Term to give you the option to enter into a new fixed-term membership based on the Membership Levels available at the time. If you do not respond to confirm a new membership, following the expiry of the Minimum Term, your Membership will automatically continue on a rolling monthly basis at the prevailing monthly rate published on our website at that time. This rolling Membership will continue until you choose to terminate it by giving us at least one months’ written notice, which can be provided online via your account. To avoid being charged for the next monthly period, your notice must be received by us at least one month prior to your next scheduled payment date. If notice is received after this point, one final monthly payment will be taken, and your Membership will end at the conclusion of that billing period.
- e. Alternatively, you can contact us (using the details in Section 9 below) at any time during your Minimum Term, provided it is at least one month before the end of your Minimum Term, to inform us that you do not wish to renew your Membership, in which case your Membership will expire at the end of your Minimum Term. If you change your mind at any point and do wish to renew your Membership, you can contact us to let us know.
- 3. Changing your membership
- a. If you wish to upgrade your Membership Level at any point during your Membership Term, you can do so via your online account. Alternatively, please contact us (using the details in Section 9 below), providing the details of the Membership Level which you would like to change to.
- b. Any change to your Membership Level during your Minimum Term will not restart your Minimum Term. The original Minimum Term will continue to apply, and any changes will take effect from the date we issue confirmation of our acceptance of the change to your Membership Level.
- c. If you upgrade to a Membership Level which has a higher Membership Fee than your current Membership Level, you agree to pay the increased Membership Fee for the remainder of your Minimum Term.
- d. You are not permitted to downgrade to a Membership Level with a lower Membership Fee during your Minimum Term.
- 4. Ending your Membership early
- a. The purchaser of a Wave Membership is legally entitled to a 14-day “cooling-off” period. We offer our UK customers a goodwill guarantee of 28 days for most products bought online or in our store, which is more generous than your legal rights.
- b. If you wish to cancel your Membership during the 28-day “cooling-off” period, please inform us in writing or otherwise cancel your Membership via your online account. We will refund to you the total Membership Fee which you have paid to us as at the date of cancellation.
- c. The right to a refund during the 28-day “cooling-off” period only applies if your Membership has not been used to book a surf session during the 28-day “cooling-off” period. If you use your Membership to book a surf session during the 28-day “cooling-off” period, you will lose your right to a refund, even if the booked session has not yet taken place.
- d. After the 28-day “cooling-off” period, if, for any reason, you want to terminate your Membership before the end of your Minimum Term, please contact us using the details set out in Section 9 Any early termination of your Membership under this Section 4.b will take effect at the end of the monthly period which your most recent Membership Fee payment relates to, during which period you may continue to access and use your Membership Benefits. You will also be required to pay an early termination fee based on the time remaining on your current Minimum Term and your Membership Fee.
- 5. Payment
- a. We will collect your Membership Fee from you by debit or credit card on a monthly basis during your Membership Term. The first payment will be processed on or shortly after the date your Membership Term starts, and each subsequent payment will be processed on or shortly after the same day of each subsequent month until the termination or expiry of your Membership Term.
- b. If, for any reason, we are unable to collect payment from you, we will notify you and ask you to provide updated payment details. We reserve the right to make unlimited attempts to collect the outstanding payment. If payment is not successfully collected within seven days of our notification, your account will be frozen, and you will not be able to surf or book any other sessions until the outstanding amount is paid in full. We also reserve the right to terminate your Membership with immediate effect, in which case your access to all Membership Benefits will cease.
- 6. Using your membership
- a. You will be able to view the details of your Membership and access your Membership Benefits via your online account. The monthly surf entitlements associated with your Membership will reset at the start of each month during your Membership Term and cannot be carried over from one month to the next. Any surf credits that are not used during the month to book surf sessions will be lost.
- b. You may use your surf credits to book surfing or bodyboarding sessions or lessons. Swimming, Play in the Bay and Little Ripper sessions are excluded from the promotion. We reserve the right to exclude new products or services from Membership benefits at our discretion.
- c. We cannot guarantee availability, so we strongly advise you to book your sessions as early as possible.
- d. To use your Membership Benefits, such as discounts on-site, you will need to present your digital Membership card.
- e. Memberships are personal to the named Membership holder and may only be used to book sessions for that individual. Membership Benefits cannot be shared, transferred, or used to make bookings for any other person. You are strictly prohibited from re-selling any surf sessions purchased as part of the Membership without our prior written consent. You are not permitted to combine any surf session with any hospitality, travel or accommodation service, merchandise or any other such package. You are not permitted to use any surf session as a competition prize. Any breach of this condition will make any associated bookings void.
- f. If you need to change or cancel a booking made under your Membership, you may do so via your online account or by contacting our Contact Centre Team at least 7 days prior to your booked session. We will make every effort to accommodate the change. If we are unable to change your booking, we will credit the cancelled session to your account. If your request is received less than 7 days before the booked session, no refund or credit will be provided, and we shall not be obliged to change your booking. No cash refunds will be available for bookings made as part of your Membership.
- g. We reserve the right to cancel or change a booking made under your Membership due to (i) safety considerations; (ii) factors beyond our control; or (iii) mechanical fault. If we need to cancel a booking, we shall use reasonable endeavours to notify you as soon as possible. If your booking is cancelled by us, we will credit the cancelled session to your account.
- 7. Your personal data
- a. All personal data which you provide us with for the purposes of your Membership will be processed in accordance with our Privacy Policy.
- 8. Changes to these Membership Terms and the Membership Options
- a. We reserve the right to make amendments to these Membership Terms from time to time at our sole discretion. A copy of the latest version of these Membership Terms (as amended, if appropriate) will always be available on our website. We will notify you of such changes by email if they materially affect your rights as a consumer.
- b. We reserve the right to make changes to the different Membership Levels from time to time, including to the Membership Fee and Membership Benefits in respect of each Membership Level. Where we do so, any such changes will only take effect upon renewal of your Minimum Term or, where you request a change in Membership pursuant to Section 3 above, our acceptance of the change to your Membership Level.
- 9. General
- a. Governing law. These Membership Terms are governed by English law. You and we both agree that the courts of England and Wales will have exclusive jurisdiction except that, if you are a resident of Northern Ireland, you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland.
- b. If a court finds part of this contract illegal, the rest will continue in force. Each of the paragraphs of these Membership Terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
- c. Nobody else has any rights under this contract. This contract is between you and us. No other person shall have any rights to enforce any of its terms.
- d. Assignment. We may assign the benefit of these Membership Terms and our rights to a third party, provided that we give you notice and your rights under these Membership Terms will not be prejudiced.
- e. Termination. Any provisions of these Membership Terms that are intended to survive termination of your Membership, including but not limited to those relating to payment obligations and changes to bookings shall continue in full force and effect notwithstanding the termination or expiry of your Membership.
